Se impone asignar a la seguridad jurídica un rol más modesto que el otorgado hasta ahora. Constituye sin dudas un valor apreciable pero no el único, ni el mejor. Antes que buscarla en un inexistente sistema jurídico ideal dotado de unidad y coherencia, se debe trabajar en la construcción de un concepto de seguridad jurídica de nuevo cuño, a través de la legitimación del actuar de los jueces y con base en la exigencia de justificación de sus decisiones. Apostamos por otro concepto de seguridad jurídica que se conciba y nutra desde otro lugar. Su verdadero valor ya no será el de una previsibilidad “inexistente, mítica e interesada” sino el del control de las decisiones judiciales.

It is imposed to assign to the artificial security a more modest list that the one granted up to now. It constitutes without doubts an appreciable value but not the only one, neither the best. Before to look for it in a nonexistent system juridical ideal endowed with unit and coherence, one should work again in the construction of a concept of artificial security stamp, through the legitimation of acting of the judges and with base in the demand of justification of their decisions. We bet for another concept of artificial security that is conceived and nurture from another place. Their true value will no longer be that of a predictability "nonexistent, mythical and interested" but that of the control of the judicial decisions.
