Este trabajo se propone describir y problematizar la definición que hace Edward Palmer Thompson de la ley penal en Los orígenes de la ley negra. Un episodio de la historia criminal inglesa. Se comenzará atendiendo al debate sobre las relaciones entre la economía y la cultura que hacia mediados de la década del setenta tuvo lugar en el seno de los estudios de tradición marxista y el campo de la historiografía social en particular. Y finalmente, se tratará de vislumbrar las implicancias epistemológicas y políticas que conllevan los presupuestos teóricos empleados por el autor en torno a la sanción legal y extralegal, buscando retomar algunos puntos de discusión sobre la justicia, la pena y la cuestión criminal para el abordaje del problema en la época actual.

This paper aims to describe and problematize the definition makes Edward Palmer Thompson of criminal law in The Origins of the Black Act. An episode of the British criminal history. It will start attending the debate on the relationship between economics and culture that by the mid-seventies took place within the Marxist tradition studies and the field of social historiography in particular.
